Acceptance
These AI-Specific Terms (“AI Terms”) supplement and form part of the Plan Your Sunset Terms of Service (“ToS”). By using any AI feature on Plan Your Sunset, you agree to be bound by these AI Terms in addition to the ToS. If you have accepted our ToS, you have also accepted these AI Terms. Capitalized terms not defined here have the meanings given in the ToS. In the event of a conflict between these AI Terms and the ToS, these AI Terms govern with respect to your use of AI features.
1. Scope
These AI Terms govern your use of all artificial intelligence features on Plan Your Sunset, including but not limited to:
- Larry, our AI assistant, available in direct chats, group chats, and document workflows.
- Document completion features that use AI to assist you in filling estate planning templates that have been created and reviewed by licensed New York attorneys. Larry helps translate your input into plain language and insert your data into these verified forms — Larry does not independently draft, create, or author legal documents. The final documents depend entirely on the accuracy and completeness of the information you supply.
- AI-powered analysis features such as document review, simplification, and follow-up suggestions.
2. AI Technology Providers
Our AI features are powered by OpenAI, Anthropic, OpenRouter, and other third-party AI providers (collectively, “AI Providers”). When you use AI features:
- Your inputs are sent to one or more AI Providers’ APIs for processing.
- AI Providers process your data solely to generate responses on our behalf.
- AI Providers should not use your data to train their AI models under our API agreements.
- AI Providers may temporarily retain API inputs for limited periods (i.e., up to 30 days) for abuse monitoring and safety purposes, after which they are deleted.
- We do not control AI Providers’ internal data handling beyond our contractual agreements.
- If we add or change AI Providers, we will update these AI Terms and post the updated version on our website with a revised “Last Updated” date.
3. AI Limitations and Risks
A. General Limitations
AI-generated content is provided for informational purposes only. You acknowledge and agree that:
- AI tools may produce errors, inaccuracies, omissions, or “hallucinations” (content that appears plausible but is factually incorrect).
- AI outputs may contain incorrect legal references, fabricated statutory citations, or provisions that do not comply with applicable law.
- AI outputs may not reflect the most current laws, regulations, or legal standards.
- The quality and accuracy of AI outputs depend on the quality and completeness of your inputs, as well as other factors beyond our control, including but not limited to the availability, performance, and configuration of our AI Providers.
B. Estate Planning-Specific Risks
Estate planning documents carry unique risks because errors may not be discovered until a critical moment — such as incapacity or death of the document creator — at which point correction may be impossible. Specifically:
- A will with incorrect beneficiary designations may distribute assets contrary to your wishes.
- A healthcare directive with non-compliant language may not be honored by medical providers.
- A power of attorney with improper provisions may be rejected by financial institutions.
- Documents that fail to meet New York State execution requirements — including proper signing, witnessing (two witnesses for wills under EPTL §3-2.1), and notarization where required — may be legally invalid. Our platform does not supervise or verify the execution process. You are solely responsible for ensuring your documents are properly executed in accordance with applicable law.
We strongly recommend that all estate planning documents completed with AI assistance be reviewed by a licensed New York attorney before execution.
4. Attorney-Client Privilege Warning
Communications with Larry and other AI features may not be protected by attorney-client privilege.
- Information you share with Larry may be processed by our AI Providers and other third-party service providers.
- AI-generated responses do not constitute confidential attorney-client communications.
- Sharing privileged information with Larry may risk waiver of privilege over that information. Courts have held that transmitting confidential communications through third-party AI systems may undermine privilege protections.
- If you are working with an attorney through our platform and wish to maintain privilege, use a separate chat that does not include Larry for privileged attorney-client communications.
5. No Legal Advice
Larry is not a lawyer and does not provide legal advice. AI features are designed to:
- Help you gather and organize information for estate planning.
- Explain general legal concepts in plain language.
- Assist in filling attorney-reviewed document templates with information you provide. Our estate planning templates have been created and reviewed by licensed New York attorneys. Larry helps translate your input into plain English and insert data into these verified forms — but the final documents depend on the accuracy and completeness of the information you supply.
- Suggest questions you may want to ask a licensed attorney.
The information and suggestions provided by Larry may be different from the information and suggestions a qualified attorney would provide. Larry’s outputs have not been reviewed by an attorney for legal sufficiency or compliance with current law.
AI features are not designed to and do not:
- Provide legal, tax, or financial advice tailored to your specific situation.
- Replace consultation with a licensed attorney.
- Guarantee the legal validity or enforceability of any document.
- Create an attorney-client relationship between you and Plan Your Sunset.
6. Your Responsibilities
Before relying on any AI-generated content, you agree to:
- Review all outputs carefully for accuracy, completeness, and applicability to your situation.
- Verify legal references — do not assume that citations to statutes, regulations, or case law are accurate.
- Consult a licensed attorney before executing any estate planning document, especially if you have complex assets, blended families, business interests, or property in multiple states.
- Not share privileged information with Larry that you wish to keep confidential from third-party systems.
7. Data Handling
For complete details on how we handle your data in connection with AI features, please see Section 4 of our Privacy Policy. Key points:
- Data sent to AI is limited to what is necessary to fulfill your request.
- Your data should not be sold or used for AI model training under our API agreements.
- We implement measures to minimize the amount of sensitive personal information transmitted to AI providers.
- AI interaction logs are retained for the duration of your active account.
8. Per-Session Acknowledgment
We may require you to acknowledge AI limitations before certain interactions, such as document completion. These acknowledgments supplement but do not replace the consent you provide when accepting these AI Terms.
9. Disclaimer and Limitation of Liability
AI FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Plan Your Sunset makes no representations or warranties regarding the accuracy, completeness, reliability, or suitability of AI-generated content for any purpose, including estate planning.
Plan Your Sunset does not warrant that AI features will be uninterrupted, error-free, or free from harmful components.
The limitation of liability set forth in Section 12 of the Terms of Service applies to all claims arising from your use of AI features. Nothing in these AI Terms limits liability that cannot be limited under applicable law, including New York General Business Law.
10. Governing Law and Disputes
These AI Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. The dispute resolution and binding arbitration provisions in Section 15 of the Terms of Service apply to any disputes arising under or relating to these AI Terms.
11. Changes to These AI Terms
We may update these AI Terms from time to time. We will post the updated version on our website with a revised “Last Updated” date. Your continued use of AI features after updated AI Terms are posted constitutes acceptance of the changes. If you do not agree to the updated AI Terms, you should stop using AI features.
